Have a careful read through these Terms of Use before launching any tile on KidsGamesOnline (referred to throughout as the "Service", the "lobby", or "we").

1. Agreement

Reaching or interacting with the Service signals that the terms below have been accepted. Visitors who do not accept them are asked to step away from the lobby. The Service operates from https://www.kidsgamesonline.ca and bundles together the subpages, embeds, and features that come and go over time. Use is also bound by our Privacy Notice and Cookie Notice.

2. Audience and younger visitors

Aqua Arcade is shaped for an audience of 13 years or older, or whatever higher floor a particular country sets, or for visitors who launch the lobby alongside a parent or guardian when their local rules require that arrangement. The Service does not deliberately funnel personal-data collection toward very young children; the Privacy Notice handles details.

3. What the Service contains

Free browser tiles and the lobby pages around them are provided here for personal, non-commercial entertainment unless something else has been authorised in writing. Any portion of the Service โ€” and any individual tile โ€” may be modified, paused, or retired at any moment, with or without an advance heads-up.

4. Restricted activities

Visitors agree not to (and not to assist anyone in) breaking the law, pushing malware or disrupting servers, scraping or indexing the lobby in ways that damage performance or sidestep our protections, attempting unauthorised access, impersonating us or fellow visitors, harassing other people, or assembling a rival directory by bulk-cloning our listings without permission. Whenever risk or abuse becomes visible, access may be restricted.

5. Tiles and third-party material

A large slice of the tiles and the assets within them is produced by independent studios. Those parties keep ownership of their copyrights and trademarks. The Service simply offers a route to discover and launch those experiences, which never transfers ownership to us. Rights holders with a concern should consult our DMCA page.

6. No warranty

THE SERVICE IS DELIVERED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WITHIN THE BOUNDS THE LAW PERMITS, WE DECLINE WARRANTIES COVERING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Uninterrupted access, error-free runs, and any guarantee that third-party tiles will prove safe, accurate, or appropriate for your needs are not promised here.

7. Limit on liability

WITHIN THE BOUNDS APPLICABLE LAW PERMITS, NEITHER KidsGamesOnline NOR ITS SUPPLIERS WILL BEAR LIABILITY FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES โ€” OR FOR LOST PROFITS, LOST DATA, OR DAMAGED GOODWILL โ€” FLOWING FROM YOUR USE OF THE SERVICE. SHOULD ANY LIABILITY ULTIMATELY ATTACH, OUR TOTAL EXPOSURE WILL BE CAPPED AT WHICHEVER IS LARGER OF (A) PAYMENTS YOU SENT US WITHIN THE 12 MONTHS PRECEDING THE CLAIM (NORMALLY ZERO FOR A FREE BROWSER VISITOR), OR (B) ONE HUNDRED U.S. DOLLARS (US$100), UNLESS A MANDATORY LAW INSISTS ON A DIFFERENT FIGURE.

8. Indemnification

You agree to defend the Service and its team โ€” and to indemnify against claims, damages, and reasonable legal fees โ€” whenever the trouble flows from a breach of these terms, misuse of the lobby, or infringement of another party's rights, except in the slice caused by our wilful misconduct where mandatory law forbids that bargain.

9. Stopping access

The Service may suspend or end any visitor's access at any time, with or without cause or warning, particularly where compliance with law or the safety of other visitors demands the move. Provisions designed to outlive these terms (think liability caps and governing-law clauses) keep operating after that moment.

10. Governing law and informal first steps

These terms run under the laws of the United States, while ignoring any conflict-of-laws rules that would push a dispute toward another country's substantive law, except in jurisdictions whose non-waivable consumer protections override that choice โ€” those protections stay live. Should an issue surface, please email contact@kidsgamesonline.ca first; an honest, good-faith conversation is preferred to formal escalation whenever it is practical to attempt one.

11. Notes for European Union and United Kingdom visitors

Consumers connecting from inside the European Union or the United Kingdom retain whatever mandatory consumer-law rights apply in the country of residence, including any access to local dispute-resolution boards where one is available. None of the language in these terms aims to strip those rights away.

12. United States export and sanctions

By using the Service you confirm you are not based in a country under U.S. embargo, are not listed on a U.S. government roster of blocked parties, and are not using the lobby in violation of export-control rules.

13. Updates to these terms

These terms can be revised over time. Whenever a revision lands, the freshly published version supersedes the old one and the "last updated" reference is moved. Significant rewrites may also surface as a lobby banner or comparable highlight. Once the effective date passes, ongoing use treats the revised terms as accepted, with the caveat that certain jurisdictions impose additional notice or explicit consent for specific kinds of change.
